The Data Protection Act 1998 requires everyone who holds personal data about their customers to inform them of what they hold, why it is held and who they will share it with.

The Fair Processng Notice covers information about children that is held by local authorities, schools and Government departments.

Schools must issue a Fair Processing Notice to pupils and / or parents and carers summarising:

  • the information held about pupils
  • why it is held, and
  • the third parties to whom it may be passed on. 

This year, after consultation with the Information Commissioner this notice has been broken down into 3 layers for both primary and secondary age pupils:

  • Layer 1 is a brief one page notice issued to parents and pupils
  • Layer 2 is a more detailed notice giving more information about the organisations who have access to this information and the use they make of it.
  • Layer 3 is the full Fair Processing Notice.

These notices supersede those issued in 2006 or earlier.
